Terms of Service

By accessing or using ArkViz AI at app.arkviz.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms, you must not access or use the platform.

ArkViz AI is owned and operated by Ananta.

ArkViz AI provides AI-powered architectural visualization services, including but not limited to:

• Exterior Rendering
• Interior Rendering
• Floor Plan Generation
• Site Plan Rendering
• AI Image Enhancement
• Image Upscaling
• AI Video Generation
• Other AI-powered design and visualization tools

Features, AI models, and services may be added, modified, or discontinued at our sole discretion.

You are solely responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities performed through your account.
• Providing accurate, complete, and up-to-date registration information.
• Promptly notifying us of any unauthorized access or suspected security breach.

You are responsible for all actions performed under your account.

ArkViz AI operates on a credit-based usage system.

• Credits are consumed based on the selected AI model, resolution, enhancement level, video duration, and other processing requirements.
• Subscription credits are renewed according to your selected billing cycle.
• Unused subscription credits remain available while your subscription remains active. In case of inactive subscription since six months, balance credits will be expired.
• Credits are automatically refunded only when a generation fails due to a verified technical issue on our platform.
• Credits are non-transferable, non-refundable, and cannot be redeemed for cash except where required by applicable law.
• Subscription fees are non-refundable once a billing period has commenced.
• All payments are securely processed through authorized payment providers.

ArkViz AI reserves the right to revise credit consumption rates at any time.

ArkViz AI reserves the right to modify, revise, increase, decrease, or discontinue any pricing, subscription plan, credit allocation, promotional offer, feature, or service at any time, with or without prior notice.

Any revised pricing or credit policy becomes effective immediately upon publication on the ArkViz AI website or platform.

You retain full ownership of:

• All files, images, drawings, and content uploaded by you.
• All AI-generated outputs created from your uploaded content.

ArkViz AI and Ananta do not claim ownership of your uploaded or generated content.

You represent and warrant that you possess all necessary rights, permissions, and licenses to upload any content submitted through the platform.

ArkViz AI uses artificial intelligence to generate visual content.

AI-generated outputs may contain inaccuracies, inconsistencies, distortions, omissions, or unexpected results.

ArkViz AI makes no warranty regarding the accuracy, originality, completeness, suitability, or fitness of any generated output.

Users are solely responsible for reviewing, verifying, and approving all generated content before using it for architectural, engineering, construction, commercial, legal, or any other professional purpose.

You agree not to:

• Upload content that infringes intellectual property rights.
• Upload unlawful, defamatory, harmful, offensive, or prohibited content.
• Reverse engineer, decompile, or attempt to access ArkViz AI source code.
• Scrape, crawl, exploit, or abuse the platform or its APIs.
• Use automated tools or bots to bypass platform limitations.
• Share or resell your account or subscription.
• Circumvent usage limits or credit restrictions.
• Use ArkViz AI for any unlawful activity.

Violation of these Terms may result in immediate suspension or termination of your account.

ArkViz AI reserves the right to limit, throttle, suspend, or restrict excessive, abusive, automated, or abnormal usage that adversely affects platform performance or other users, regardless of available credits.

We strive to provide reliable and uninterrupted services; however, we do not guarantee continuous availability or 100% uptime.

ArkViz AI relies on third-party infrastructure and AI providers including, but not limited to:

• Google Gemini
• Google Veo
• OpenAI
• Anthropic Claude
• Replicate
• RunPod
• Google Cloud Platform
• DigitalOcean
• Stripe
• Razorpay

Service interruptions, delays, outages, maintenance, API limitations, or changes affecting these providers are beyond our control. ArkViz AI shall not be liable for any loss, delay, interruption, business impact, or damages resulting from such third-party services.

Certain AI models or features may be designated as beta, preview, or experimental. These features may change, produce inconsistent results, or be discontinued at any time without prior notice.

All software, branding, logos, website content, user interface designs, graphics, trademarks, and proprietary technology used by ArkViz AI remain the exclusive property of Ananta or its licensors.

Except for your own uploaded content, no part of the platform may be copied, reproduced, modified, or distributed without prior written permission.

ArkViz AI is provided on an "as is" and "as available" basis without warranties of any kind.

To the maximum extent permitted by applicable law, ArkViz AI, Ananta, its owners, employees, affiliates, licensors, partners, and service providers shall not be liable for:

• Indirect, incidental, special, or consequential damages.
• Loss of profits, revenue, goodwill, business opportunities, or data.
• Delays or interruptions in service.
• AI-generated outputs that fail to meet expectations.
• Errors, omissions, or inaccuracies in generated content.
• Failures of third-party AI providers or infrastructure.

Our total cumulative liability shall never exceed the total amount paid by you to ArkViz AI during the three (3) months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless ArkViz AI, Ananta, its directors, employees, affiliates, licensors, and partners from any claims, damages, liabilities, losses, costs, or expenses arising out of:

• Your use of the platform.
• Your uploaded content.
• Your violation of these Terms.
• Your infringement of any third-party rights.

We reserve the right to suspend, restrict, or permanently terminate your account without prior notice if you violate these Terms, engage in fraudulent or abusive activities, misuse the platform, or compromise its security or integrity.

You may terminate your account at any time through your Account Settings.

ArkViz AI shall not be liable for any failure or delay in performing its obligations resulting from events beyond its reasonable control, including but not limited to natural disasters, internet outages, cyberattacks, government actions, labor disputes, power failures, pandemics, or failures of third-party infrastructure or AI service providers.

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Anand, Gujarat, India.

ArkViz AI reserves the right to amend, modify, or replace these Terms of Service at any time. Updated Terms become effective immediately upon publication on the platform or website. Continued use of ArkViz AI constitutes acceptance of the revised Terms.
